Terms of service
These general terms and conditions apply to every purchase and to all use of the services offered by ORY Berlin, operated by bloomers communication GmbH, Auguste-Viktoria-Str. 91, 14193 Berlin. By buying from us or using our services, you accept these terms.
Scope & contracting parties
These terms apply to all contracts between bloomers communication GmbH (hereinafter "ORY Berlin") and consumers (Section 13 of the German Civil Code, BGB) as well as businesses (Section 14 BGB) who buy products and services through the online shop ory-berlin.de or affiliated platforms.
Terms of the customer that differ from, conflict with or add to these terms do not become part of the contract unless we have agreed to them expressly and in writing (Section 305(1) BGB).
To use the shop and to buy from it you must be at least 18 years old or have the consent of a parent or guardian.
How the contract is formed
The products shown in the shop are not a binding offer, but an invitation to make an offer (invitatio ad offerendum).
The contract of sale comes about as follows:
- You put products in the basket and click "Order with obligation to pay"
- We send an automatic acknowledgement by email (this is not yet a contract)
- The contract is concluded when we send the dispatch confirmation or an express order confirmation
ORY Berlin may turn down orders without giving reasons — for example if a product is unavailable or there is a problem with payment. In that case the full purchase price is refunded.
Prices & payment
All prices are in euros and include VAT at the statutory rate (currently 19 %, or 7 % on food and food supplements). Shipping costs are shown separately during the order process.
The price shown when you order is the price for that contract. Price changes apply to future orders only — contracts already running are not affected.

Delivery
We deliver within the European Union and to other European countries. The countries we deliver to are shown at checkout.
| Product category | Delivery time |
|---|---|
| Food supplements & products | 1–3 working days (DE) / 3–5 working days (EU) |
| Diagnostic kits | 2–5 working days (DE) / 3–7 working days (EU) |
For consumers, the risk of accidental loss of or damage to the goods passes to you only when they are actually handed over (Section 475(2) in conjunction with Section 447(1) of the German Civil Code, BGB). International deliveries may attract local customs duties or import taxes, which are paid by the buyer.
Diagnostic kits must be stored and used at the right temperature, as set out in the instructions supplied with them. ORY Berlin is not liable for damage caused by improper handling after delivery.
Statutory warranty
The statutory warranty rights apply. For consumers the statutory warranty period is 2 years from delivery (Section 437 of the German Civil Code, BGB, in conjunction with EU Directive 2019/771) — this period is required by law and cannot be shortened by contract.
| Product category | Applies to | Does not apply to |
|---|---|---|
| Food supplements | Wrong contents, damaged packaging, contamination on delivery | Products already used, best-before date passed after delivery |
| Diagnostic kits | Manufacturing faults, incorrect laboratory evaluation caused by technical failure | Opened hygiene seal, activated kit |
Where a defect is established, you are entitled to:
- A remedy — a replacement or a fresh evaluation
- A reduction in the purchase price
- Withdrawal from the contract if the defect cannot be put right
Please report defects to office@bloomers-berlin.de, with your order number and a description of the problem. We will come back to you within 2 working days.
Right of withdrawal
ORY Berlin voluntarily grants an extended right of withdrawal of 30 days — instead of the 14 days required by law (Section 312g of the German Civil Code, BGB). The period starts when you receive the goods.
For sealed products (food supplements, diagnostic kits) the right of withdrawal ends as soon as the hygiene seal is broken after delivery — on health protection grounds (Section 312g(2) no. 3 BGB).
You will find the full withdrawal policy, including the model withdrawal form, here:
Liability
ORY Berlin is liable without limit for:
- Intent and gross negligence
- Injury to life, body or health
- Claims under the German Product Liability Act (ProdHaftG)
Where a material contractual duty is breached through slight negligence, liability is limited to the damage typically to be expected under such a contract. Beyond that, liability for slight negligence is excluded.
Content and products from ORY Berlin are no substitute for medical advice or treatment. Diagnostic results are information to work from — not medical diagnoses. ORY Berlin accepts no liability for health decisions taken on the basis of our products or content.
Using the shop
The shop may be used for lawful purposes only. The following are prohibited in particular:
- False details when registering or ordering
- Automated access (bots, scraping) without permission
- Reselling diagnostic kits without express permission
- Misuse of the review system or of customer support
ORY Berlin reserves the right to block accounts that breach these rules.
Copyright & content
All content on ory-berlin.de — text, images, logos, designs, analysis reports — is protected by copyright and either belongs to bloomers communication GmbH or is licensed to it.
Copying, editing or distributing it without express written permission is not allowed. Diagnostic reports may be saved for personal use.
Data protection
Personal data is processed in line with our privacy policy and the requirements of the GDPR.
Changes to these terms
ORY Berlin may change these terms with effect for the future. Contracts already concluded stay governed by the version that applied when the order was placed.
Registered customers are told about significant changes by email. The version currently in force is always available on this page.
Dispute resolution & applicable law
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For merchants, the place of jurisdiction is Berlin.
The European Commission provides a platform for online dispute resolution: ec.europa.eu/consumers/odr
Our email: office@bloomers-berlin.de
ORY Berlin is neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration body.
Severability
If individual provisions of these terms are or become invalid, the remaining provisions stay in force. Invalid clauses are replaced by the relevant statutory rules.
